Consumer Rights – Withdrawal – Cancellation Return Conditions

GENERAL:

 

1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and distance sales contract presented to you.

 

2.All Buyers are subject to the provisions of the Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts (RG: 27.11.2014 / 29188) and other applicable laws regarding the sale and delivery of the product they purchase.

 

3.Shipping charges, which are product shipment costs, will be paid by buyers.

 

4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, the Buyers may terminate the contract.

 

5. The purchased product must be delivered completely and in accordance with the qualifications specified in the order and with documents such as warranty certificate and user manual, if any.

 

6. In the event that it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days of learning about this situation. The total price must be returned to the Buyer within 14 days.

 

IF THE PRICE OF THE PURCHASED PRODUCT IS NOT PAID:

 

7.If the buyer does not pay for the purchased product or cancels the payment via banking records, the seller is no longer obligated to deliver the product

 

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

 

8. After the product is delivered, if it is determined that the credit card paid by the buyer is used unfairly by unauthorized persons and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days at the expense of the SELLER.

 

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

 

9. If unforeseen circumstances beyond the control of the seller occur and the product cannot be delivered on time, the buyer will be informed. The buyer may choose to:Cancel the order,Replace the product with a similar one, orPostpone delivery until the obstacle is resolved.

If the buyer cancels the order: For payments made in cash, the total amount will be refunded in cash within 14 days of cancellation. For payments made via credit card, the refund will be processed to the bank within 14 days of cancellation. However, the bank may take 2-3 weeks to transfer the amount to the buyer's account.

 

 

BUYER'S OBLIGATION TO CHECK THE PRODUCT:

 

10. The buyer must inspect the product/service before accepting delivery. Damaged or defective items, such as those with dents, cracks, or torn packaging, must not be accepted from the shipping company. If the product/service is accepted, it is considered to have been delivered in good condition.

After delivery, the buyer must carefully protect the product/service. If the right of withdrawal is to be exercised, the product/service must not be used. Additionally, the invoice must be returned along with the product.

 

 

RIGHT OF WITHDRAWAL:

 

11.BUYER; Within 14 (fourteen) days from the delivery date of the purchased product to him or to the person/organization at the address indicated, he may use his right to withdraw from the contract by rejecting the goods without assuming any legal and criminal liability and without giving any reason, provided that he notifies the SELLER via the contact information below.

DURATION OF THE RIGHT OF WITHDRAWAL:

 

13. If the purchased item is a service, the 14-day withdrawal period starts from the date the contract is signed. If the provision of the service begins with the consumer's consent before the expiration of the withdrawal period, the right of withdrawal cannot be exercised for such service contracts.

 

 

14. The costs incurred from exercising the right of withdrawal are the responsibility of the SELLER.

 

15. In order to exercise the right of withdrawal, a written notification must be made to the SELLER by registered mail, fax or e-mail within 14 (fourteen) days and the product must not be used within the framework of the provisions of the "Products for which the Right of Withdrawal cannot be used" regulated in this contract.

 

EXERCISE OF THE RIGHT OF WITHDRAWAL:

 

16.3. The invoice of the product delivered to the person or the BUYER, (If the returned product's invoice was issued to a corporate entity, the return must be accompanied by a return invoice issued by the corporation. Returns for products invoiced to corporations cannot be processed without a RETURN INVOICE.)

 

17. Return form, The products to be returned must be delivered complete and undamaged, together with their box, packaging, standard accessories, if any.

 

RETURN CONDITIONS:

 

18. The SELLER is obligated to refund the total price and return any documents placing the BUYER under financial obligation to the BUYER within 10 days of receiving the withdrawal notification. The goods must also be retrieved within 20 days.

 

19. If the value of the goods decreases due to the BUYER's fault or if the return becomes impossible, the BUYER is required to compensate the SELLER for damages in proportion to their fault. However, the BUYER is not responsible for changes or deterioration resulting from proper use of the goods during the withdrawal period.

 

20. If the use of the right of withdrawal causes the total order value to fall below the promotional threshold set by the SELLER, any discounts or benefits applied within the campaign will be voided.

 

 

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

 

21. Products prepared in line with the BUYER's requests or clearly tailored to personal needs, as well as items that are not suitable for return, such as innerwear bottoms, swimwear and bikini bottoms, cosmetics, single-use items, perishable goods, or items that may expire quickly, cannot be returned if their packaging has been opened by the BUYER after delivery, due to health and hygiene reasons. Additionally, products that are mixed with other items after delivery and cannot be separated by their nature, goods related to periodicals like newspapers and magazines (excluding those provided under a subscription agreement), services performed immediately in an electronic environment, intangible goods instantly delivered to the consumer, and audio or video recordings, books, digital content, software programs, data recording and storage devices, or computer consumables whose packaging has been opened by the BUYER cannot be returned under the Regulation. Furthermore, it is not possible to exercise the right of withdrawal for services that have commenced with the consumer’s consent before the withdrawal period ends, as per the Regulation.

 

22. Cosmetic and personal care products, innerwear items, swimwear, bikinis, books, copyable software and programs, DVDs, VCDs, CDs, and cassettes, as well as stationery supplies (such as toner, cartridges, ribbons, etc.), must be unopened, unused, intact, and undamaged in order to be eligible for return.

 

DEFAULT AND LEGAL CONSEQUENCES

 

23. If the BUYER defaults on payment made with a credit card, the BUYER acknowledges, declares, and undertakes that they will be responsible for paying interest to the bank under the terms of the credit card agreement between the cardholder and the bank. In this case, the relevant bank may resort to legal measures, demand the incurred costs and attorney's fees from the BUYER, and under any circumstances, if the BUYER defaults due to the debt, the BUYER agrees to pay for the damages and losses suffered by the SELLER due to the delayed performance of the debt.

24. Payment can be made via Bank Transfer or EFT (Electronic Funds Transfer) to any of our bank accounts at …………, ………, bank in (TRY).

 

25. Through our website, you can make payments with your credit card using either a one-time payment or online installment options for all types of credit cards. The payment will be charged to your credit card at the end of the order.
